By using the UCARBONEX.com website or UCARBONEX products, you represent and warrant that:

  1. You are 16 years of age or older; OR
  2. If under 16, you have obtained verifiable consent from a parent or legal guardian;
  3. Your use of UCARBONEX.com and UCARBONEX products does not violate any applicable law.



UCARBONEX may terminate access without notice if there is reasonable belief that a user is under the age of 16 without proper consent.

Parents or legal guardians who consent to a minor’s use agree to be bound by all Terms regarding the minor’s activity.

UCARBONEX operates using SquareUp services and an official eBay store.




Section 1 — General Terms (Important — Read Carefully)


These Terms of Service (“Terms”) constitute a binding legal agreement between you (“Client,” “User,” or “Purchaser”) and UCARBONEX, a sole proprietorship (“UCARBONEX”).

Access to and use of this Site—including purchasing products—is subject to:

  • All applicable laws and regulations
  • Any modifications UCARBONEX may make at its sole discretion



UCARBONEX may modify these Terms at any time. Continued use of the Site and continued purchasing constitutes acceptance of all changes.

UCARBONEX reserves the right to refuse service to anyone at any time, for any reason or no reason.

Section 2 — Limitation of Liability (Important — Read Carefully)


IN NO EVENT SHALL UCARBONEX OR ITS AFFILIATES BE LIABLE FOR ANY DAMAGES OF ANY KIND—INCLUDING BUT NOT LIMITED TO CONSEQUENTIAL, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR SPECIAL DAMAGES—ARISING FROM:

  • Use or misuse of UCARBONEX products
  • Unauthorized third-party use
  • Improper installation
  • Modification, alteration, or unusual stress on products
  • Any theory of liability (contract, strict liability, tort, negligence)
  • Situations where UCARBONEX was or was not warned of possible damages



The purchaser assumes full responsibility for determining product suitability.
UCARBONEX is not responsible for damages to vehicles, bicycles, equipment, drivers, operators, passengers, or property.

Exclusion of Liability:
No liability exists for products that are:

  • Modified
  • Misused or abused
  • Used in racing, competition, extreme riding, commercial use
  • Involved in accidents
  • Neglected or used outside normal conditions






Section 3 — Assumption of Risk & Indemnification (Important — Read Carefully)


You acknowledge and agree that:

  1. You are solely responsible for the safe operation of any bicycle, vehicle, or carbon fiber product.
  2. Carbon fiber products can malfunction, even when properly maintained.
  3. You must perform a safety inspection before every use. Do not use products that fail inspection.
  4. Using bicycles, vehicles, or carbon fiber products involves inherent and unavoidable risks including:
  • Collisions
  • Road hazards
  • Environmental hazards
  • Mechanical failure
  • Third-party actions
  • Weather conditions
  • Rider error
  1. You assume all known and unknown risks associated with use.



If your use of UCARBONEX products causes injury or damage to any person or property, you may be personally liable.


Release & Indemnification


YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS UCARBONEX AND ALL ASSOCIATED PARTIES FROM ANY INJURY, DEATH, DAMAGE, OR LOSS ARISING FROM:

  • Your use of UCARBONEX products
  • Your negligence
  • Your failure to follow instructions or safety guidelines






Definitions


“UCARBONEX,” “Company,” “We,” “Us,” and “Our” refer to the UCARBONEX business and website.
“Client,” “User,” “Customer,” “Purchaser,” and “End User” refer to the individual or entity purchasing or using UCARBONEX products or services.

By using UCARBONEX.com or purchasing UCARBONEX products, you agree to all Terms herein.




Warranty Exclusions


Warranty is void if the product has been:

  • Modified
  • Neglected
  • Used in extreme riding, racing, or competition
  • Misused or abused
  • Involved in an accident
  • Installed improperly
  • Exposed to extreme heat
  • Subject to normal wear and tear
  • Affected by UV-related yellowing over time



UCARBONEX retains the right to determine whether damage is user error.




Disclaimer


UCARBONEX is not liable for injuries or damages caused by:

  • Driver error
  • Incorrect installation
  • Accidents
  • Environmental conditions
  • Poor judgment
  • Acts of nature



Your sole remedy for dissatisfaction with the Site or products is to discontinue use.




General Warnings

  • Stunting, trick riding, ramps, aggressive riding, carrying heavy loads, or commercial use is inherently dangerous and fully at the rider’s risk.
  • Carbon fiber can be damaged internally without visible signs. Damaged carbon may fail suddenly and result in injury or death.
  • Stop use immediately if damage is suspected.
  • Improper or rushed installation may scratch or damage products.
  • If carbon fiber is ingested, seek immediate medical attention.
  • Clean wounds exposed to carbon debris.






Advisory


Reselling UCARBONEX products voids all warranties.




Inspection & Complaints


The Client must:

  • Inspect products immediately upon delivery
  • Report defects in writing within 5 days of receipt
  • Cease using defective products immediately



Failure to follow these requirements voids all rights to complaint to reach a solution for SELLER & BUYER.




General Terms of Sale

  • Discounts may be modified or discontinued at any time.
  • Removal of UCARBONEX trademarks is prohibited.
  • Installing custom parts may void factory warranties.
  • UCARBONEX is not liable for failure to perform due to force majeure, including natural disasters, theft, war, carrier disruptions, or labor strikes.
  • Prices may change at any time based on raw materials and market conditions.






Shipping & Returns



Lost or Stolen Packages


You must file a claim with the shipping carrier. Signature confirmation can be added for an additional fee.


Damaged Shipments

  • Notify UCARBONEX and the carrier immediately.
  • Take photos upon delivery.
  • Products damaged by the purchaser are not refundable.




Missing Items


Send photos of the package and contents. Verified mistakes will be corrected.




Genuine Product Verification


UCARBONEX tracks every fabricated and sold part. A part is genuine ONLY if:

  • It exists in UCARBONEX records, and
  • It bears a UCARBONEX logo or identifying mark



Purchasing from third parties requires verification of the original UCARBONEX receipt.




Chemicals & Materials Disclosure


Products may contain:

  • Carbon fiber
  • Polymers
  • Automotive waxes
  • Water-based and oil-based paints
  • Adhesives and other standard automotive materials



If allergic or sensitive, discontinue use.




Trademark Notice


UCARBONEX and the “U” logo are registered trademarks.
Personal use is permitted.
Reproduction for resale is strictly prohibited and may result in legal action.
